1. Introduction

These Terms of Service ("ToS") set out the rules that govern your use of the Avitree Platform — encompassing the websites www.avitreebikes.com and www.avitreeworld.com and the Avitree mobile application — operated by Bhansali Bizgrow LLP ("Avitree", "we", or "us"). By accessing or using the Platform you agree to be bound by these ToS. If you do not agree, please do not use the Platform.

 

These ToS supplement and should be read alongside Avitree's Privacy Policy, Terms and Conditions, Cancellation Policy, and Refund Policy, all of which form part of the agreement between you and Avitree.

2. Platform Access

•       Avitree grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes.

•       Avitree reserves the right to modify, suspend, or discontinue any part of the Platform at any time without notice.

•       Avitree may restrict access to certain features of the Platform to registered Users.

•       Avitree is not liable if the Platform is unavailable at any time or for any period.

3. Prohibited Activities

When using the Platform you must not:

 

•       Reproduce, duplicate, copy, sell, or exploit any part of the Platform without Avitree's express written permission

•       Use any automated tool (bots, scrapers, spiders) to extract data from the Platform

•       Attempt to decompile, reverse-engineer, or disassemble any software or systems forming part of the Platform

•       Introduce viruses, trojans, worms, or other malicious or technologically harmful material

•       Attempt to gain unauthorised access to the Platform, its servers, or any database connected to it

•       Transmit unsolicited commercial communications (spam)

•       Use the Platform in any way that violates applicable local, national, or international laws

4. Intellectual Property Rights

All intellectual property rights in the Platform and its content — including but not limited to the Avitree brand name, logo, product designs, images, text, and software — are owned by or licensed to Avitree. Nothing in these ToS transfers any intellectual property rights to you. You may download or print content from the Platform solely for your personal, non-commercial use.

5. Third-Party Links and Services

The Platform may contain links to third-party websites and services. Avitree is not responsible for the content, accuracy, or practices of any third-party website. Links do not constitute an endorsement. Avitree shall not be liable for any loss or damage that may arise from your use of third-party sites.

6. Disclaimer of Warranties

The Platform and all content thereon are provided on an 'as is' and 'as available' basis without any representation or warranty of any kind, express or implied. To the fullest extent permitted by law, Avitree disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Avitree shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from: (i) your use of or inability to use the Platform; (ii) unauthorised access to or alteration of your data; (iii) any third-party conduct on the Platform; or (iv) any other matter relating to the Platform or products sold thereon.

8. User-Generated Content

If you submit reviews, comments, photographs, or other content to the Platform, you grant Avitree a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, publish, and distribute such content in connection with Avitree's business. You represent that you own or have the necessary rights to such content and that it does not infringe any third-party rights.

9. Warranty Registration

All bicycles must be registered on the Platform within 30 days of purchase to activate the manufacturer's warranty. Warranty claims must be supported by proof of purchase and lodged through an authorised Avitree dealer or service centre. The warranty does not cover damage caused by misuse, modification, or unauthorised activities.

10. Severability

If any provision of these ToS is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

11. Entire Agreement

These ToS, together with the Privacy Policy, Terms and Conditions, Cancellation Policy, and Refund Policy, constitute the entire agreement between you and Avitree with respect to your use of the Platform and supersede all prior agreements and understandings.

12. Governing Law & Contact

These ToS are governed by the laws of India. Any dispute arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra.
