1. Acceptance of Terms

These Terms and Conditions ("Terms") govern the use of the Avitree Platform (www.avitreebikes.com, www.avitreeworld.com, and the associated mobile application) and the purchase of products thereon by Users. By accessing, browsing, or transacting on the Platform, the User irrevocably accepts these Terms along with all policies incorporated herein by reference, including the Privacy Policy, Cancellation Policy, Refund Policy, and Warranty Policy.

 

These Terms are an electronic record as defined under the Information Technology Act, 2000 and are generated by a computer system without any physical or digital signature.

2. Eligibility

Use of the Platform is available only to persons who can enter into legally binding contracts under applicable law. Persons who are minors (under 18 years of age) may use the Platform only under the supervision of a parent or legal guardian. Avitree reserves the right to terminate accounts of Users found to be ineligible.

3. User Account

•       You are responsible for maintaining the confidentiality of your User ID and password.

•       All information provided during registration must be accurate, current, and complete.

•       You are solely responsible for all activities that occur under your account.

•       Notify Avitree immediately of any suspected unauthorised access to your account.

•       Avitree reserves the right to suspend or permanently cancel accounts found to provide false or misleading information.

4. Products and Pricing

Avitree makes every effort to display product descriptions, specifications, images, and pricing accurately. However, product packaging may vary from images displayed, and Avitree does not guarantee that descriptions will precisely reflect the delivered product.

 

In the event of any typographical error or technical glitch resulting in incorrect pricing or specifications, Avitree reserves the right to rectify the error and, where an order has been placed at an incorrect price, to cancel the order and process a full refund within 90 (ninety) working days.

 

All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

5. Orders and Delivery

•       Placement of an order constitutes an offer to purchase; a binding contract is formed only on Avitree's dispatch confirmation.

•       Avitree reserves the right to refuse or cancel any order at its sole discretion without liability, with applicable refunds processed per this Policy.

•       Bicycles are delivered in approximately 85% assembled condition. The customer is responsible for installing pedals, adjusting and tightening the handlebar, and fitting any accessories ordered, using the tools supplied in the small parts box.

•       Customers must photograph/video the delivery packaging before unboxing. If the delivered box is damaged or open, do not accept delivery — return it to the courier with a remark on the proof-of-delivery slip.

•       Delivery timelines are estimates and may vary owing to logistics constraints or Force Majeure events.

6. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, product images, software, and compilations — is the proprietary intellectual property of Avitree or its licensors and is protected under applicable Indian and international intellectual property laws. No content may be reproduced, distributed, modified, or used for commercial purposes without the prior written consent of Avitree.

7. User Conduct

Users agree to use the Platform only for lawful purposes. You must not:

 

•       Place false, fraudulent, or speculative orders

•       Use the Platform to transmit harmful, offensive, or unlawful content

•       Attempt to gain unauthorised access to any part of the Platform or its systems

•       Misrepresent your identity or affiliation

•       Violate any applicable local, national, or international law or regulation

8. Limitation of Liability

To the maximum extent permitted by law, Avitree shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profit, data, or goodwill — arising from your use of the Platform or products purchased thereon. Avitree's aggregate liability in connection with any order shall not exceed the value paid for that specific order.

9. Force Majeure

Avitree shall not be held responsible for delay or failure in fulfilling its obligations arising from events beyond its reasonable control, including but not limited to natural disasters, pandemics, war, government actions, civil unrest, power failures, or cyberattacks. Avitree will make reasonable efforts to minimise disruption.

10. Indemnification

You agree to indemnify and hold harmless Avitree, its affiliates, directors, officers, employees, and agents from and against all claims, losses, damages, and costs (including reasonable legal fees) arising from: (i) your violation of these Terms; (ii) your breach of any applicable law; or (iii) your use of the Platform.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra. Avitree encourages Users to contact customer support at connect@avitreeworld.com before initiating legal proceedings, as most concerns can be resolved amicably.

12. Modifications

Avitree reserves the right to amend these Terms at any time. Continued use of the Platform following any modification constitutes your acceptance of the revised Terms. Users are encouraged to review the Terms periodically.
